ORDERED AND ADJUDGED that the Motion of the Plaintiffs,

L. A. SASSER and JUDY SASSER, his wife, for a rehearing on the

basis of newly discovered evidence is denied. This Order
shall be without prejudice to the rights of the Plaintiffs
to file a separate law .suit for breach of the written
' construction contract dated September•23, 1977, and this Order
shall not be construed to pass either directly or indirectly
on the sufficiency of any legal or evidentiary issue raised
thereby.
