This case, having come before the Court on Plaintiffs' Motion
for Default and Motion for Judgment on the Pleadings, the Court finds
as follows:
(1) Plaintiffs and Defendant have admitted that Defendant,
NETTLE'S ISLAND, INC., has corrected all the procedural defects com-
plained of in Plaintiffs' complaint, since the Temporary Injunction
was issued by the Court on+ February 13, 1980.
(2) Since there is no farther injunctive relief to be granted ~
by the court, the factual issues in this case are now moot.
THEREFORE, IT IS HEREBY ORDERED AND ADJUDGED:
(1) This action is hereby disutissed with prejudice.
(2) The Court shall retain jurisdiction for determining the
prevailing party in this action and also determining the award of -
costs and attorney fees to the prevailing party.
(3) The hearing on costs and attorney fees is set by the Court
for April 28, 1980, at 2:15 P.M., before Judge Phillip Nourse,~St.
Lucie County Courthouse. _
(4) The Court further retains jurisdiction for the purpose of
determining the release of the $2,000.00 cash bond paid into-the regis-
try of the Court by Plaintiffs.
