FINAL JUDGMENT
THIS MATTER having come before the Court on the trial of the
issue of negligence and damages and pursuant to a verdict rendered in
this action on March 27, 1980, wherein a duly empaneled jury entered
a verdict signed by the foreperson, RALTZ W. HANCOCK, in assessing
the damages of the Plaintiff, WILLIAM JAMES FRANKLIN, in the amount of
THIRTY-FIVE THOUSAND AND NO/100 DOLLARS ($35,000.00), against the
Defendants, EARL S. BURGAN and NATIONWIDE MUTUAL LIFE INSURANCE COMPANY,
and the verdict further assessing the damages of the Plaintiff, ELIZABETH
FRANKLIN, in the amount of THREE THOUSAND AND NO/100 DOLLARS ($3,000.00), .
against the Defendants, EARL S. BURGAN and NATIONWIDE MUTUAL LIFE
INSURANCE COMPANY, it is
ORDERED that the Plaintiff, WILLIAM JAMES FRANKLIN, recover from
the Defendants, EARL S. BURGAN and NATIONWIDE MUTUAL LIFE INSURANCE
COMPANY, the sum of THIRTY-FIVE THOUSAND AND NO/100 DOLLARS, ($35,000.00)
for which let execution issue, and that the Plaintiff, ELIZABETH
FRANKLIN, recover from the Defendants, EARL S. BURGAN and NATIONWIDE
~ MUTUAL LIFE INSURANCE COMPANY, the sum of THREE THOUSAND AND NO/100
DOLLARS ($3,000.00), for which let execution issue. It is further
ORDERED.AND ADJUDGED that the Court reserve jurisdiction for
entrance of cost judgment to be heard upon proper notice and filing of
the motion.
