O R D E R' -
THIS CAUSE came on before the Court on the Defendants'
Motions to Dismiss and Strike, and the Court after hearing
and due consideration thereof does hereby
ORDER A1VD ADJUDGE as follows:
1. The Motion to Dismiss filed by the individual L
Defendants', RAYMOND EDDLEMAN and VIRGINIA EDDLEMAN, directed
to the Second Amended Complaint is denied -as to Count I, de-
nied as to Count II, and granted as to Count III.
2. The Motion to Strike filed by the individual De- ~

III fendants', RAYMOND EDDLEMAN and VIRGINIA EDDLEMAN, directed ;
to the Second Amended Complaint is denied in all respects

as to Counts I and II, and as to Count III the issue is
moot inasmuch as the Court has granted said Defendants' Mo-
tion to Dismiss Count III.

3. The Motion to Dismiss and/or Strike filed by the
Defendant, WESTERT7 AUTO SUPPLY CORPOPATION, directed to the
Second Amended Complaint is ~3enied. The Court will, however,
reserve its ruling as to the issue-of punitive damages until }
~ trial time.
4. The parties shall have twenty (20) days within
which to respond to the Second Amended Complaint.
