SUMMARY FINAL JUDGMENT IN FORECLOSURE
This cause having come to be heard on the Plaintiff's Motion
for Summary Final Judgment, and the Court being fully advised in the
premises, it is thereupon
ORDERED AND ADJUDGED as follows:
1. That the Court has jurisdiction over this cause and the
subject matter and the parties.
2. The default judgments previously entered herein are
ratified and confirmed.
3. That the mortgage herein sued upon by the Plaintiff was
legally executed, acknowledged, delivered and recorded as is alleged
in Plaintiff's Complaint; that the Promissory Note thereby secured
was also properly executed and delivered; and that the said Promissory
Note and Mortgage were and do constitute a valid and subsisting lien
I upon the real property of the Defendant, Ernest L. Smith, which
property is hereinafter described.
4. That the default in making the payments of the principal
and interest upon the said note constitutes a breach of the covenants
of the Mortgage herein sued upon.
5. That the Defendant, Ernest L. Smith, has defaulted in making
the payments of the principal and interest upon the said Promissory
Note and now owe the Plaintiff on account of the principal and interest
on said Note and~to:, gage, the sum of S ~ which figure.
includes amounts paid by the Plaintiff on behalf of the Defendants,
late charges and interest accruing to the date of this Judgment,
r together with the sum of 7 Q b. ~ which is hereby awarded as
attorne s' fees for the services of the Plaintiff's attorneys herein,
