THIS CAUSE came on to be heard before the Court on -the
Amended Motion to Dismiss filed by counsel for the Defendant,
OCEANRISE OF HUTCHINSON ISLAND, INC. and the Plaintiff's Motion to
transfer case to Circuit Court and the Court having heard argument
of counsel; considereu the memorandum submitted in support thereof
- and further considered the stipulations of the respective parties
filed herein and being otherwise duly advised in the premises, it
is therefore,
ORDERED AND ADJUDGED that: f
1. The Amended Motion to Dismiss filed by counsel for
the Defendant, OCEANRISE OF HUTCHINSON ISLAND, INC., is hereby
denied .
2. Venue of this cause is hereby transferred to Circuit
Court, St. Lucie County pending Plaintiff's payment of additional
filing fees as required by the Clerk of said Court.
