This cause, having come on to be heard before me,
upon Motion of Che Defendants EUGENE GIBBON and MADGE MORINE
GIBBON to dismiss the Amended Complaint of Plaintiff, which
hearing was held on April 1, 1980, and this Court having
heard the argument of counsel for the parties and being
otherwise fully advised in the premises, it is upon consideration
ORDERED AND ADJUDGED that the Amended Complaint be and
the same is hereby dismissed. Plaintiff HORACE FROMMELT.~.s granted
ten (10) days from this date to file his Second Amended CoraPlaint

in this action.
