HomeMy WebLinkAbout2419 RECEIPT, Aclwol~~wiDCTQilVr, Assu~u_rloN AND ncclil''I'ANCI: or• PuR(]U1Sr:R Purdiaser, by acceptance-and exec~uti~n of this Receipt, acknowledges that this purchase of a condominitml unit at OC1iAN V1 LI.ACIi OF Nlfl'C1IINSON ISLAND is subject in every respect to the Declaration of Condominium :is to the condominium in which his unit is located and Exhibits attached thereto, including but not limited to («l~ether the same are attached to the Declaration or referred to therein), the By-La~.~s of the Association, Articles of IncoYporation, the Rules and Regulations, copy of projected operating budget, copy of sales brochure and floor plan of apartment purchased by purchaser, and all Amend- ments to the aforesaid Declaration and Exhibits and the Articles of Incomoration, By-Laws and Declaration of Covenants and Restrictions of the Property Owners' Association; and Purchaser further acknowledges receipt of and reading and examination of said Declaration, its Exhibits, and budget, sales brochure and floor plan, and acknowledges that each and every provision of the foregoing is essential to the successful operation and management of the Condominium property and is in the best interests and for the benefit of all the owners therein. Purchaser and all owners of parcels in the aforedescribed CAndominium j covenant and agree to abide by each and every provision of said Declaration of Condominium and Exhibits attached thereto. Purchaser hereby ratifies and confirms and approves all of the terms and provisions of said Declarations of Condominium and Fxhibits attached thereto, and-agrees that the assessment under the Property Owners' Association documents referred to above and the provisions thereof-are reasonable, fair and equitable, and said Purchaser acknowledges and confirms that the Declaration of Covenants and Restrictions of the Property Owners' Association has encumbered and impressed a lien upon the Condo- minium parcel being conveyed to Purchaser, as security for his obligations under the said Declaration of Covenants and Restrictions of the Property Uaners' Association and said Purchaser assumes the obligations as to t}~e Property Qarners' Association as to his - condominium parcel. Purchaser confirms that all warranties, representations and induce- ments, if any, are as contained in the aforesaid Declaration of Condominium and Exhibits attached thereto, and the common expenses and the sums due under the-Property U,~ners' Association and other charges are estimated only. 1\b warranty or guaranty is made or intended nor may one be relied upon except i~lieie the same is specifically warranted or guaranteed in said Declaration~of Condominium and the Exhibits attached thereto.
