It is specifically agreed that time is of the essence of this , contract and that no waiver of any obligation hereunder or of the obligation secured hereby shall at any time be held to be a waiver of the terms hereof or of the instrument secured hereby. 12. If foreclosure proceedings of any second mortgage or second ~ trust deed or any junior lien of any kind should be instituted, the Mortgagee may, at its option, immediately or thereafter declare this Mortgage and the indebtedness secured hereby due and payable forthwith, and may at its option Qroceed to foreclose this Mortgage. 13. To pay all and singular the costs, charges and expenses, in- a~luding attorney's fees for a_11 services including litigation and any and all appeals therefrom, reasonably incurred or paid at any time by the Mortgagee Qecause of the failure of the Mortgagor(s) to perform, comply with and abide by each and every the stipulations, agreements, conditions and covenants of $aid Promissory Note and this Deed or either, and every such payment shall; bear interest from date at the same rate as the principal indebtedness, pay- I}ble semi-annually. - 14. Mortgagor(s) covenant that (he,she,they) and the Association responsible for the operation of the Condominium will observe all of the provisions of the Declaration of Condominium which is recorded in the public records of Palm Beach County, Florida, and of the Condominium Act, and will erform their obligations under the said Declaration and Act; and a failure ~o do so which is not cured within thirty (30) days after notice given by the Mortgagee to the Mortgagor(s) or the Association shall constitute a' default under this Mortgage. Mortgagor(s) specifically covenant, but not by way of limitation, that they and the Association will observe all of the - provisions of the Declaration of Condominium pertaining to insurance coverage.
