Mortgagor represents and warrants that prior existing mortgages and any other permitted encumbrances are current and in good standing, and covenants and agrees to maintain same in good standing during the life of this mortgage. 7. If default shall be made for a period of FIFTEEN (15) days in payment~of any installment of principal or interest on the attached note or any part thereof when due, or in payment wher< due, of any other sum secured hereby; without notice or demand ' which are hereby expressly waived, or in the performance of any of Mortgagor's obligations, covenants or agreements hereunder, then, all the indebtedness secured hereby shall become and be immediately due and payable at the option of the .Mortgagee, in which event, i Mortgagee may avail itself of all rights and remedies, at law or in equity, and. this mortgage may be foreclosed with all rights ~ and remedies afforded by the laws of Florida and Mortgagor shall pay all costs, charges and expenses thereof, including reasonable attorneys fees and attorneys fees on appeal. g. No delay by Mortgagee in exercising any right or remedy hereunder, or otherwise afforded by law, shall operate as a waiver thereof, or preclude the exercise thereof during the continuance of any default hereunder. No_waiver by Mortgagee of any default shall constitute a waiver of or consent to subsequent defaults. No failure of Mortgagee to exercise any option herein given to accelerate maturity of the debt hereby secured, no forebearance by Mortgagee before or after the exercise of such option, and no withdrawal or abandonment of foreclosure proceedings by Mortgagee shall be taken or construed -2- ~~W _
