LAST WILL AND TESTAMENT OF EDWARD G.KELLY - Page Two
situate and whether acquired before or after the execution
of this Will, to my wife, MARTHA L. KELLY, as her own abso-
lutely, provided she survives me.
CLAUSE V: If my wife, MARTHA L. KELLY, does not
survive me, then all of my residuary estate shall be dis-
tributed as follows:
A. $25,000.00 to my sister, MARGARET M. KELLY,
405 Eighth Street, Donora, PA, provided she
survives me.
B. $25,000.00 to my daughter, BONNIE KELLY
NIEMAN, provided she survives me.
C. The balance of my residuary estate I give
and devise to my trustee hereinafter named,
IN TRUST, nevertheless, for the following
uses and purposes, to wit:
1. During the lifetime of my sister,
MARGARET M. KELLY, the trustee shall pay
all of the net income in convenient install
ments to or for the benefit of my said
sister. In addition, the trustee may pay
as much of the principal of this trust as
the trustee determines to be necessary for
the health, maintenance, welfare, support
and education, including higher education of
my sister, MARGARET M. KELLY, my daughter,
BONNIE KELLY NIEMAN, and my said daughter's
children. Upon the death of my sister,
MARGARET M. KELLY, this trust shall continue
for the benefit of my daughter, BONNIE KELLY
NIEMAN, and during her lifetime the trustee
shall pay all of the net income in convenient
installments to or for the benefit of my said
- daughter. In addition, the trustee shall pay
as much of the principal of this trust as
the trustee determines to be necessary for
the health, maintenance, welfare,~support
and education, including higher education of
my said daughter and my said daughter's
children. Upon the death of my daughter,
BONNIE KELLY NIEMAN, this trust shall cease
and terminate and the then balance thereof
shall be distributed outright equally to
the then living children of my daughter,
BONNIE BELLY NIEMAN, per stirpes.
CLAUSE VI: I name and appoint my wife, MARTHA L. KELLY,
as personal representative of this Will, to serve without bond,
and in the event she shall die, resign or be unable for any
