LAST WILL AND TESTAMENT OF EDWARD G. BELLY - Paqe Three
to act or to continue acting as such, then I name and appoint
CHESTER B. GRIFFIN, Fort Pierce, Florida, as such personal
representative, to serve without bond. In the event CHESTER
B. GRIFFIN shall die, resign or be unable for any reason to
act or to continue acting as such, then I name and appoint
SUN BANK OF ST. LUGI73 COUNTY, or its corporate successor,
as such personal representative.
I further name and appo~-SUN BANK OF ST. LUCIE
COUNTY, Fort Pierce', Florida, or its corporate successor, as
trustee of any trust which may be created under this Will.
In order to carry out the purposes of the trust
created under this Will, the trustee shall have all of the
powers duties and responsibilities granted to trustees under
Chapters 737.402 and 738, Florida Statutes, and my personal
representative shall have all of the rights, powers, duties
and responsibilities granted under Chapters 733.612, 737.402
and 738, Florida Statutes.
CLAUSE VII: In the event that my wife, MARTHA L.
BELLY, and I die under such circumstances that it cannot
be determined which of us predeceased the other, I direct
that it shall be conclusively presumed that I survived my
said wife, and the provisions of this Will and any Codicil
hereto, shall be construed and the distribution of property
shall be governed and regulated as if I had, in fact, sur-
vived my said wife.
IN WITNESS WHEREOF, I have hereunto set my hand and
seal, this 21st day of December , 1976 .
