ORDER ON MOTION TO DISMISS
THIS cause heard by the Court on April 22, 1980 upon
the Motion to Dismiss the Complaint filed by Defendant, OUTDOOR
RESORTS OF AMERICA, INC., and the Court having reviewed the
Motion, heard argument of counsel and being otherwise duly
informed of the premises, it is
ORDERED AND ADJUDGED that:
1. The Motion to Dismiss Count I of the Complaint is
hereby taken under advisement by this Court, which will allow
the parties ten (10) days from the date of this Order to file
I
Memoranda of Law in support of their respective positions, and
an additional ten (10) days thereafter to respond to the Memoranda
submitted.
2. Defendant's Motion to Dismiss Count III is hereby
denied, and Defendant shall have twenty (20) days from the date
of this Order to answer Count III.
3. Defendant's Motion to Dismiss Count IV of the Complaint
is hereby granted, with leave to Plaintiff to amend the Count

- within ten (10) days from the date of this Order.
