ELECTION TO TAKE TITLE TO PROPERTY
AS TENANTS IN COMMON
i
The undersigned, T. Daniel McCain being one
of the devisees under paragraph TWO of the Last Will and Testament
of Catherine McCain, deceased, who died on the 5th day of June,
1978, domiciled in the County of Tippecanoe, State of Indiana,
states as follows: ~
The decedent's Last. Will and Testament was probated on the
7th daY of July, 1978, in Tippecanoe County, Indiana, and that
thereafter an ancillary administration of this estate was commenced
in this court on the day of ,CJ~CBJr,~ ~fi! 19 r18' ,
Paragraph~TWO of decedent's Last Will and Testament provides °
as follows:
"TWO: At the time of.the execution of this ~
will I have nine (9) lots in the State of
Florida. If my nephews, Douglas C. McCain,
T. Daniel McCain and David R. McCain, wish to
have one or more of these lots, they may take
their choice in the following manner: Douglas
shall first choose the lot of his choice, Daniel {
may then choose the lot of his choice, and David _
may then choose the lot of his choice. They-may
then make second and third choices in the same
order. If my said nephews or any of them do not
wish to select one or more lots in this fashion,
they may pass and I bequeath to them a sum of
money so as to equal their shares from my estate
` received by the provisions of this paragraph of
my will."
That the nine lots referred to in said paragraph TWO are as
follows
