In the event of the death of a party hereto, then a
certified and registered property appraiser shall be employed to
appraise the partnership property. The party then living shall
have the right to purchase the property from the deceased••~?arty~s
estate for i/2 the appraised value. _
8. The intention of this agreement is that both partners
own 1009 interest. If one dies or desires to sell to the_ othex,
the price shall be one-half of the 10096 evaluation, to-wit, 50~.
9. Each party-understands and agrees that he is a
.fiduciary of the other party and accountable as such.
10. The provisions of Section 620.68, Florida `Statutes
(1977) shall be incorporated herein by reference unless in conflict
herewith:
11. Any property, real, personal or mixed other than that
stated above, shall be taken into account when there shal`1 be a
dissolution or other termination•of this partnership, when appraising
the value of said partnership. -
12. In the event there shall be any litigation in a court
of proper 3urisdiction to enforce any provision of this agreement,
the prevailing party shall have a right to reasonable attorney fees
incurred.
