ORDER
THIS CAUSE having come on to be heard this 29th day
of April, 1980, upon the Plaintiff's Motion to Compel and
the Defendant's Motion to Compel, and each party being repre-
sented by counsel. J. Michael Brennan, Counsel for the Plaintiff,
and Richard D: Sneed, Jr., Counsel for the Defendant, having
agreed in open Court to stipulate to have affidavits in lieu
of live testimony for attorney's fees, and the Court being
otherwise fully advised in the premises, it is
' ORDERED AND ADJUDGED the parties hereto shall submit

affidavit as to attorney's fees in lieu of live testimony, and
it is further

~ ORDERED AND ADJUDGED that Defendant, MADSEN BUILDERS,
3 INC., shall provide the name of the drafter, representative
of Port St. Lucie Bank and representative of First Federal
Savings and Loan to be used at trial to Plaintiff's counsel
~ within ten (10) of the date of this Order, and it is further

ORDERED AND ADJUDGED that neither parties is assessed
- costs or penalty.
