on Defendants' Motion to Dismiss, and the Court having heard
argument of counsel and being otherwise fully advised in the
premises, it is hereby s
ORDERED that the "Sheriff's Department of St. Lucie County"
is not a legal entity and as such cannot sue or be sued in the _
State of Florida. Accordingly, this action is dismissed with ~

j prejudice as to the current defendant. It is further ~
i ORDERED that the Complaint herein is otherwise deficient in
that it fails to allege the existence and breach of a duty owed to
the Plaintiff.
