' THIS MATTER having come on before me this day upon
the Motion to Dismiss filed by the defendants/appellees, -
argument of counsel having been heard and the Court being
otherwise fully advised in the premises finds and determines
i
as follows: -
1. That the plaintiffs/appellants, TROY LEE SHEARER
and MARY HELEN SHEARER, his wife, filed their timely notice
of appeal on January 31, 1980. - 1
2. That the Clerk of this Court erroneously advised
plaintiffs/appellants that this matter should be handled by
filing a new action and not as an appellate matter.
3. That pursuaht thereto the plaintiffs/appellants filed
a complaint and served same on the defendants/appellees on
E February 8, 1980.

4. That-this matter is properly handled as an appeal.
It is therefore ORDERED AND ADJUDGED as followsi
i
a. That the fee paid by. plaintiffs/appellants to the
Clerk of Circuit Court as a filing fee in the amount of $27.00
should be credited against plaintiffs/appellants' costs in
~ pursuance of this appeal.

b. That the appeal shall proceed with the Clerk of the

~ Board of Adjustment filing the official record with the Clerk
of the Circuit Court within oZ 0 days of the date of this
Order.
c. That within twenty (20) days of the plaintiffs/appellants'
