defendant's Motion to Dismiss, argument of counsel being heard
and the court being fully advised in the premises it is, upon
consideration,
ORDERED AND ADJUDGED that:
1. The motion be, and the same is hereby, denied.
2. Third party defendant shall have twenty (20) days
from this date in which to file responsive pleadings.

interim, the offer of judgment is accepted.
