as the case may be, and the conveyance of fee simple title
to each parcel described herein shall be subject to the following
easements.
Section 1. In ress E ress Service and Maintenance
Easement. A perpetual, non-exc us ve easement s ere y created,
grantees-and established in favor of the Owner of each and every
parcel, and the Owner's successors and assigns, over such portions
of the parcels described in Exhibit B attached hereto, exclusive
of the Townhouses, as may reasonably be necessary for ingress to
and egress from such Owner's Parcel and Townhouse and as may
reasonably be necessary for repair, maintenance, delivery,.
utilities, pickup, fire protection services, police and other
authorities of the law, United States mail carriers, representatives {
of utilities and holders of valid mortgage liens on any of the ~
Parcels, and for the purpose of performing maintenance on such
Owner's Parcel or Townhouse.
Section 2. Pre-Existin Easements. Pre-Existing _
Easements for utilities, sewage, rainage
ingress and egress
as may be shown on a recorded plat of the subdivision of the
property which is the subject matter of this Declaration or other
documents which are of public record, are hereby ratified and
confirmed.
ARTICLE V
MISCELLANEOUS
Section 1. Enforcement. Any Owner shall have the right
to enforce by any procee ing at aw or in e-quityj all of the
Declarations, Restrictions, Conditions,_Easements, Party Walls,
Servitudes, or Conditions, now or hereafter imposed by the
provisions of this Declaration.
Section 2. Severability. Invalidation of any one
of these covenants or restrictions by a Judgment or Court Order ~
shall in no way effect any other provisions which shall remain ~
in full force and effect.
II Section 3. Amendment or Termination. This Declaration
may be amended or terminate y u y recor ing an instrument
in the public records of St: Lucie County executed and acknowledged
j by all of the Owners of the property which is the subject matter
hereof together with any Mortgagees of record.
~ Section 4. Duration. Unless terminated as previously
~ set forth herein, the Restrictions and Conditions of this Declaration
~ shall run with and on the land and shall inure to the benefit
of and be enforceable by each Owner for a period of thirty (30)
years from the date hereof. Thereafter, they shall automatically ;
be extended for additional periods of ten (10) years, unless
otherwise agreed to in writing by the then Owners of all of the
Parcels.
IN WITNESS WHEREOF, Declarant, LeROY S. CALVERT and
CATHERINE CALVERT, his wife, have caused this Declaration to be
