TO COMPEL PRODUCTION RESORe v~s~u+~~__
Defendant's Motion to Compel Production, dated April 22, 1980,
came before the .Court on April 30, 1980. The Court having
considered the pleading and having heard argument of Counsel finds
and orders as follows:
1. The defendants have not promulgated interrogatories nor
taking depositions prior to filing this motion. They are entitled
to under F1a.R.Civ.P. 1.280(b)3.
2. Plaintiff has filed its Construction plans in Court
on April 30, 1980, and the Court will permit all plans and maps
to be checked out of the Court file for use by defendants and
€ - -
their attorneys.
! 3. F1a.R.Civ-. P. 1.280 is applicable to discovery in this action.
IT IS ORDERED AND ADJUDGED that
4. The request to produce is denied as to paragraphs 1-6.
As to paragraph 7, Plaintiff shall make available a list of permits
for the Construction project concerning this parcel.
Defendants are to promulgate interrogatories and conduct
depositions before issuing any additional request to produce.
