TO COMPEL PRODUCTION
Defendant's Motion to Compel Production, dated April 22, 1980,
came before the Court on April 30, 1980. The Court having
considered the pleading and having heard argument of Counsel finds
and orders as follows:

1. The defendants have not promulgated interrogatories nor
taking depositions prior to filing this motion. They are entitled
to under Fla.R.Civ.P. 1.280(b)3.
2. Plaintiff has agreed to file Construction plans within
30 days which shall be available-for defendants and their attorneys

~ 3. F1a.R.Civ.P. 1.280 is applicable to discovery in this action.
IT IS ORDERED AND ADJUDGED that
The request to produce is denied.
Plaintiff shall make available a list of permits for the
Construction project concerning this parcel.
