FINAL SUNII~IARY JUDGMENT
THIS CAUSE came on to be heard on Plaintiffs' Motion for
Final Summary Judgment, and the. Court having heard argument of
counsel for the parties and being of the opinion that Plaintiffs'
Motion is meritorious, however, upon Defendant's ore tenus
motion for the submission of a pleading in opposition to the _
Motion for Summary Judgment, the Court grants said motion and
the same shall be filed within ten (10) days of entry of this
Order, and upon failure of Defendant to file an appropriate
pleading, it is
ORDERED and ADJUDGED that Final Summary Judgment be and
is hereby entexed for the Plaintiffs, SHIRLEY NINES and CHARLES •
t NINES, and against the Defendant, GEORGE MACKEY, and it is
FURTHER ORDERED and ADJUDGED that the Court reserve ruling
on taxation of costs pending proper motion and hearing in this
~ matter.
