MODIFIED LEASE AGREEMENT
THIS AGREEMENT made and entered into this _a~~
day of 1980, by and between LUCILLE V, COSTA,
joined by her husband GEORGE A. COSTA (hereinafter referred
to as "Lessor") and TRIPLE T INNS OF FT. PIERCE, INC., a
Florida Corporation, (hereinafter referred to as "Lessee"). -
WHEREAS, by Lease Agreement dated October 25,
1972, Lessor did enter into a Ground Lease Agreement with -
Saint Lucie Enterprises, Inc., a Florida Corporation; and
- WHEREAS, by Assignment of Lease Agreement dated ~
September 25, 1975, and ratified and confirmed by another
Assignment of Lease Agreement dated July 12, 1979, Saint
Lucie Enterprises, Inc., assigned all of its right, title
and interest under said Lease Agreement to Bear's Nest,
a New Jersey Corporation, qualified to do business in
the State of Florida as Bear's Nest, Inc. (hereinafter
referred to as "Bear's Nest"); and
WHEREAS, by Assignment of Lease Agreement of even
date herewith, Bear's Nest has assigned alI of its right,
title and interest under said Lease Agreement to Lessee; and
WHEREAS, the parties hereto desire to modify
certain terms and ,conditions of the said Lease Agreement
into a Modified Lease Agreement.
NOW, THEREFORE, in consideration of the foregoing, -
Ten Dollars ($10.00) and the mutual covenants and conditions
of each of the parties hereto, it is hereby agreed as follows:
1. Lessee hereby assumes the aforesaid Lease Agreement
ad modified hereunder and agrees to perform and abide by all.
terms, covenants and conditions thereof.
2. Lessor hereby accepts Lessee's assumption of
the aforesaid Lease Agreement as modified hereunder.
3. Triple T Inns of Fort Pierce, Inc., a Florida
Corporation, is hereby substituted as "Lessee" under this
Modified Lease Agreement in place of Saint Lucie Enterprises,
Inc. and/or Bear's Nest.
