3. The above-described real property is not homestead.
4. Notice to Creditors has been duly published in this
cause, according to law, and the time within which creditors
may file claims against the estate has expired. No claims
have been filed against Che estate.
5. Said real property is not subject to specific devise
in the last will and testament of the decedent.
6. The residuary beneficiaries of the estate of the
decedent are the undersigned, Helen Holton Anderson and '
Anne Holton McCreary, who also joins in this Motion and hereby
gives her consent and ratification to the sale of the above-
described real property .upon the terms and conditions stated
herein.
7. The above-described real property and improvements
located thereon have been sold for $35,000.00 cash, which sale
is in the best interests of the residuary beneficiaries of this
estate, in order to facilitate the distribution of the assets
of the estate.
8.~ The last will and testament of the decedent, JULIA -
CATHERINE HOLTON, provides in "Item Eighteen" that the personal
representatives shall have the right of public or private sale,
and upon terms as shall be decided by the personal representa-
tives, in their sole discretion. "Item Nineteen" gives the
personal representatives the power to make, execute and deliver
such deeds or other instruments as shall be necessary to carry
out the terms of the last will and testament of the decedent.
WHEREFORE, Helen Holton Anderson and Henry G. Anderson,
her husband, as the duly qualified and acting personal repre-
sentatives of the Estate of JULIA CATHERINE HOLTON, deceased,
joined by Anne Holton McCreary, pray that this Court enter an
Order confirming the sale of the above-described real. property,
together with improvements located thereon, for a purchase
