1. Bach purchaser of a Lot shall receive fee simple
title to it. It shall be the duty of the unit owner to properly
- maintain the three (3) foot wide unimproved area adjacent to the
building including the Courtyard, on each side of the Dwelling
Unit that does. not abut another Dwelling-Unit according to the
same standard of care as the common areas. This three (3) foot
area is for lawns or other landscaping and not. for the
construction of any building, fence or other structure. _
2. Sach Lot shall be conveyed together with, and
subject to, the following easements:
A. An easement for the continuance of all
encroachments by any building on any adjoining Lot or Lots and
Common Areas existing as a result of the construction of each
building, or which may come into existence hereafter as a result
of settling or shifting of any building, or as a result of repair
or restoration of any building after damage or destruction by fire
or other casualty or after .taking by condemnation or eminent
domain proceedings, or by reason of an alteration or repair to the
Common Areas or any buildings.
- B. An easement in common with the owners of any
other Dwelling Units to use any sewer pipes, water pipes, wires,

ducts, cables, conduits, public utility lines and electric meter i
boxes located in, on, or under any of the other Dwelling Units,
i
buildings or elsewhere on TARPON BAY VILLAS and which serve any
Dwelling Units; -
C. An easement in common with the owners of any
~ other Dwelling Units for ingress and egress on all private roads,
driveways, walks and parking areas that are part of the Common
` Area. This easement is to extend up to the most recently
r
developed Lot. '
f D. The right to use all other Common Areas for the
-purpose for which they were constructed.
