3. Bach Lot shall be conveyed subiect to an easement
to ANDRBW A. HENRY and ALBERTA D. HBNRY, their heirs and assigns,
for ingress and egress of passenger and recreational vehicles
only, on all private roads. driveways, walks and parking areas
that are-part of the Common Area, said easement to extend from
Pruitt Road on the east, to the western boundary of the TARPON BAY
VILLAS Common Area, so long as that parcel of land running from
the westernmost boundary of TARPON BAY VILLAS to the shores of
Bitching Cove is used for one single-family residence. All
Dwelling bnit owners agree to the granting of this easement.
4. The easements, licenses, rights and privileges
established, created .and granted by .this Instrument shall be for
the benefit of, and restricted solely to, the Owners from time to~
time of Dwelling Units in TARPON BAY VILLAS, their tenants,-,the
families of such owners or tenants and their guests, for the
duration of their ownership or tenancy, but the same is not
intended nor shall it be construed as creating any rights in or
for the benefit of the general public.

( Every record fee simple Owner of a Dwelling Unit in

this development, including the Developer agrees to become and

~ shall be a member of the Association, provided that any person or

~ entity who holds such interest only as security for the
performance of an obligation shall not be a member. At such time

as said Owner no longer holds fee simple ownership of any Dwelling

Unit, membership in the Association ceases.
B. CLASSES OF MB[rIBERSHIP
The Association shall have classes of membership as
set forth in Article IV of the Amended Articles of Incorporation
of the. Tarpon Bay Villas Homeowners Association, Inc.
