HomeMy WebLinkAbout0993 i respective legal representatives, heirs, successors or assignees, for a term of fifty (50) years iron the date this Amended Declaration is recorded, after which tine said Amended Covenants, Restrictions and 8asenents shall automatically be extended for successive periods of ten (10) years unless an instrument signed by the then Owners of two-thirds (2/3) of the Dwelling Units has been recorded in the public records of St. Lucie County, Florida, agreeing to change or terminate said Amended Covenants, Restrictions and Easements in whole or fn. part. At any time during an automatically extended period, a docwaent agreeing to the change may be recorded and is effective as of the date of recording. This portion of this section concerned with change or termination by a two-thirds (2/3) vote of Owners shall have no application so long as Developer shall be the owner of one Lot or one Dwelling Unit-of any Property affected by this Declaration, or for a period of two ( 2 ) years from the date of the recording in the Public Records of St. Lucie County, Florida, of this Amended Declaration of Covenants, Restrictions and Easements, whichever event first occurs. ' 2. Enforcement. Violation or breach of any condition, i ' covenant or restriction herein contained shall give the Developer and/or Association and/or Owner(s) in addition to all other remedies, the right to proceed at law or in equity to compel compliance with the terms of said conditions, covenants or restrictions, and to prevent the violation or breach of any of them, and the expense of such litigation shall be borne by the then Owner or Owners of the subject property, provided such proceeding results•in a finding that such Owner was in violation of said Amended Covenants or Restrictions. Expenses of litigation a shall include reasonable attorney's fees incurred by Developer, the Association, and/or the individual Unit Owner in seeking such enforcement. ~ 3. Waiver.
