I, AI.BEaf L. ROSFN, being duly sworn on oath,. make affidavit and state:

1. That during the calendar year 1978 I was engaged as Corporate Counsel i
by General Develofinent Corporation, a Delaware corporation authorized to do busi-
ness in the State of Florida, and directed by it to prepare Declaration .of
Covenants and Restrictions for certain. lots situated in the First Replat in
Port St. Lucie Section Forty-Two according to the plat thereof recorded in the
Public Records of St. Lucie County, Florida in Plat Book 18 at Page 18 which property ~
was designated as Windmill Point II Property Owner's Association, Inc.
2. That due ,to a Scrivener's error and contrary to the intention of the
Declarant, certain errors and/or mistakes were contained in the following described
doc~unent to-wit:
a) The original Declaration of Covenants and Restrictions dated
July 19, 1978 with reference to the property above referred
to which Declaration of Covenants and Restrictions was re-
corded in the Public Records of St. Lucie Crnmty, Florida
in Official Record Book 291 at Pages 132 to 153 both in-
clusive.
b) That the errors and/or mistakes were contained in Schedule A
attached to said Declaration of Covenants and Restrictions
wherein the blocks and lots in said association and situated
in said First Replat of Port St. Lucie Section Forty-Two ac-
cording to the plat thereof recorded in Plat Book 18 at Page
18 of the Public Records of St. Lucie County, Florida, were
j defined.
~ c) That upon discovery by General Development Corporation of
{ said errors and/or mistakes the undersigned was authorized
~ and directed to execute and file in the Public Records of
St. Lucie County, Florida an Affidavit correcting the
Scrivener's errors with reference tcs said Schedule A attached
to said Declaration of Covenants and Restrictions in order to
properly set forth the intention of Declarant. ?
3. That pursuant to such authority this Affidavit is made and executed to
be filed in the Public Records of St. Lucie County, Florida correcting the
E Scrivener's errors hereinbefore referred to so that Schedule A of said Declaration

of Covenants and Restrictions will be corrected to conform with the intention of ~

~ the Declarant and will provide in Schedule A thereof the following corrections

t0-Wlt:
a) Block 3313 should be changed to indicate Lots 1 through 23
and Block 3317 should be changed to indicate Lots 1 through
23, and further, that the total number of lots should be
changed from 470 to 468. .
