4. That the Plaintiff has continuously held title in and to 4
the subject real property since first acquiring same by deed dated ~
January 26, 1963, and recorded in O.R, Book 58, at page 602, of the

public records of St. Lucie County, Florida. j`
5. That the attempt by the Plaintiff to convey the subject
land which was the homestead of the Plaintiff and her family was
void as the attempted conveyance by Warranty Deed dated June 22, 1966,
and recorded in O.R. Book 148, at page 532, of the public records of '
St. Lucie County, Florida, was. without joinder by her spouse and as
.such, was in violation of the Constitution of the State of Florida, as
it existed at that time. The law at that time provided that a married
woman's deed is not effective unless her husband joins in the conveyance
(Section 693.01, .OS and 708.04, .08, Florida Statutes 1963).

6. That the Plaintiff has continuously resided on the subject
property as her homestead since acquiring title to same in 1963 until
the present.
7. That the Defendant, PHYRNE~HANKS, formerly known as PHYRNE
ALEXANDRA HICKMAN, deemed the daughter of the Plaintiff, SUSAN
HICKMAN COULD, formerly known as SUSAN K. HICKMAN, and ALFRED M.
HICKMAN, and her husband, DONALD~HANKS, have never held any interest
in and to the subject property nor have they acquired any such interest

e in and to the subject property.
ZT IS CONSIDERED, ORDERED AND ADJUDGED that the Plaintiff,
SUSAN HICKMAN COULD, formerly known as SUSAN K. HICKMAN, is found to
be the fee simple title holder to the lands described above and that
title to the said land is hereby quieted in her and that certain
Warranty Deed from the Plaintiff to her husband, ALFRED M. HICKMAN,

dated June 22, 1966., recorded on June 22, 196b, in O.R. Book 148, at
Y
page 532 of the public records of St. Lucie County, Florida, is held
to be void ab initio and of no force and effect.
