Counterclaimants Motion to Amend the Counterclaim and upon Plaintiff/
Counterdefendants Motion to Strike Affirmative Defenses and the Court
having considered argument of counsel and being otherwise fully
advised in the premises, it is ~
ORDERED AND ADJUDGED as .follows: !
~ 1. That Defendant/Counterclaimant's Motion to Amend the
Counterclaim is hereby granted and Defendant/Counterclaimant's
Second Amended Counterclaim is deemed filed May 1, 1980. ~
2. That Plaintiff/Counterdefendant is given fifteen (15)

j days from the date of this Order in which to respond to the Second
Amended Counterclaim. ~
3. That Plaintiff/Counterdefendant's Motion to Strike i.

~ Affirmative Defenses is granted only as to the following: }
a. The second paragraph of Defendant/Counter-
claimant's first affirmative defense is stricken. -
b. Defendant/Counterclaimant's third affirmative
defense is stricken except as to Count I of Plaintiff/
Counterdefendant's Amended Complaint.

denied in all other respects.
