(a) That the Motion for Sumanary Judgment be and the same is
hereby denied.
(b) It is established that there is a discharge of liquid
from the elevated drainfield of the Crossroads Motel, which be-
longed to the defendants Joseph J. and Mary Ann Lach, his wife,
which appears to flow into a northerly direction and into a ditch
located on the property of the plaintiffs, 2ir. and Mrs. D. J.
Tzimenatos.
DONE AND ORDERED in Chambers at Fort Pierce, St. Lucie County,
Florida, this /3~day of May, 1980.
