FINAL JUDGMENT
THIS MATTER was tried non-jury. Plaintiff claimed
damages as the result of defendant's breach of an oral agree-
ment with plaintiff. Defendant denied by answer and set forth
various affirmative defenses including plaintiff's failure to
comply with Florida Real Estate Lawf defendant requested set-
offs as the result of plaintiff's actions causing loss to
defendant and alleged overdraws, and defendant counterclaimed
~ for damages.
- With the Court's permission, plaintiff amended his
complaint to more accurately set forth the amount of plaintiff's
claim, and defendant's answer was permitted to stand as a general
denial to the amendment..
The Court heard testimony of the parties and their
respective witnesses, and reviewed the exhibits submitted in
evidence. Plaintiff claims an oral agreement with defendant
wherein plaintiff was to be general manager of the defendant`s
construction business at a weekly salary of $200.OOt in addition,
he was to receive five (St) per cent of every sale of residence
built by defendant, including extras. The defendant admitted
