4. Defendants Motion to Strike Plaintiff's "Motion
for Contempt" as sham is granted. The notice .
of taking depositions given by Plaintiff to
said Defendants was inadequate, and Defendants
were under no duty to attend said depositions
or respond in any way to the subpoenaes issued -
in connection with them. Plaintiffs made no
effort to subpoenae the proposed deponents as
witnesses at the hearing on Plaintiff's Motion
for Contempt, nor did Plaintiffs present any
evidence by way of affidavit in opposition to
'i the affidavit provided by counsel for said
defendants.
