PRUDBNTIAL PROPBRTY AND CASUALTY INSURANCB COMPANY
THIS CAUSB came on for non-fury trial on April 29,

1980 on the crossclaim and amended crossclaim of Prudential
Property and Casualty Insurance Company, and answer to cross-
claim. Upon the evidence presented to the Court, the Court
fiords:
On January 12, j,978, Edward J. Kennedy was operating
a 1977 Toyota camper in St. Lucie County, Florida, and at that
time, was involved in an accident with the Plaintiff, Claude T.
Jackson. At the time of the accident, this Toyota camper was
owned by McManus and Kennedy, Professional Association, and

Edward J. Kennedy had the discretionary right to use this

vehicle at all times. Edward J. Kennedy was an attorney-at-

law and was practicing with the law firm of McManus ~ Rennedq,
Professional Association. At the time of the accident, Edward
J. Kennedy was carrying insurance with crossplaintiff, Prudential
Property and Casualty Insurance Company, and this policy speci-
fically covered a 1975 Datsun B-210. This policy was for a six
month period, commencing January 11, 1978. The Datsun was used
primarily by Mr. Kennedy's wife,. and the Toyota camper was used
by Mr. Kennedy for business, personal and recreational uses.
Subsequent to the accident, on March 24, 1978, Mr. Kennedy applied ~
for an endorsement of the Prudential policy to specifically in-
clude the Toyota camper, with an effective coverage date of April
1, 1978. (CP-3).
