Seller shall promptly advise Purchaser of such adjustment and the parties do hereby agree that any such adjustment in the monthly payment of prindpal, interest and taxes shall supersede the basic amount of 1686.00 set forth above. Further, it is understood and agreed by the parties that Purchaser may, upon giving at least thirty (30) days written notice to Seller, request delivery by Seller of a General Warranty Deed conveying the subject real property to Purchaser, their successors or assigns, subject to either of the following conditions having been satisfied at the time request is made of Seller: (a) Purchaser shall have elected to assume the existing above-described first mortgage at the interest rate then prevailing at the time request for the Warranty Deed is made and shall otherwise have qualified with the Mortgagee for assumption of said mortgage and paid all costs and fees associated therewith; or - (b) Purchaser shall have tendered payment in full, including any pre- payment penalty, for satisfaction of the said first mortgage. Upon either of the foregoing conditions having been satisfied, Seller shall deliver in recordable form, a General Warranty Deed do the Purchaser, their successors or assigns, subject only to: (a) taxes for the year of conveyance. if not paid. (b) the above-described first mortgage, if not satisfied, and (c) those matters set forth in f the title insurance commitment or binder heretofore furnished by Seller. Purchaser acknowledges that as of. or prior to, the date of this Agreement for Deed, they have received a commitment or binder from a title insurance company author- ized to transact business in the State of Florida, evidencing good and marketable title in E Seller -and Purchaser agrees that no further evidence of title shall be required of Seller. Seller warrants and represents that there are no spedal assessments pending or due with respect to the above-described condominium unit nor is Seller aware of an dame es which have heretofore occurred to the condominium buildin in y g g f which the subject unit is located which would subject the said unit to a spedal assess- ment for repairs . The Purchaser shall be permitted to go into possession of the property covered r by this Agreement on the date of its execution by all parties, and shall assume all liability for insurance , taxes and maintenance from and after that date .
