ORDER ON PRE-TRIAL CONFERENCE
Pre-Trial Conference having been held on May 14, 1980,
at 1:15 P. M., it is •
ORDERED AND ADJUDGED:
1. STIPULATIONS AND ADMISSIONS. The Pleadings indicate
that the parties admit and stipulate to the following:
a. Defendants applied One Thousand Dollars ($1,000.00)
down toward the purchase price of the home and the Plaintiff was to
retain 'said amount if the Defendants did not close.
b. The parties initially made valuable consideration
for the contract which is the subject matter of this lawsuit insofar
as the Plaintiff allowed the Defendants to move in to the property and
the buyers paid One Thousand Dollars ($1,000.00) down and paid the
~ first month's rent in advance.
c. The Defendants had to be evicted from the premise's
which is the subject matter of this lawsuit.
d. The Defendants placed the Plaintiff's house on the
market and were trying to sell the Plaintiff's house before they owned
the Plaintiff's house.- ,
e. The ,prevailing party is entitled to Attorney's fees.
f. On or about August 16, 1979, the Defendants were noti-
fied by Certified Mail that they were in default of their lease and pur-
chase agreement, that the Plaintiff was declaring a forfeiture of One `

Thousand Dollars ($1,000.00), and that they then owed One Thousand,
Nine Hundred Dollars ($1,900.00) in back rent, and giving the Defendants
