CONCERTINA NARDELLI,
Incompetent.
PETITION FOR LEAVE TO SELL PROPERTY OF WARD
Petitioner, ROGER N. MESSER, as guardian of the property of
CONCERTINA NARDELLI, an Incompetent, respectfully alleges:
1. The above named ward is the owner of certain real property,
which petitioner desires to sell, described as the house located at
116 Alma Court, Fort Pierce, Florida, more particularly described as:
Hopkins Subdivision, West 108 Feet of Section II,
Lot 4, St. Lucie County, Florida.
2. Petitioner considers that it is expedient and necessary
to sell the property described above for the following reasons:
A. The ward is presently residing in Easter Manor Nursing Home
and has assets, other than said real property, in an amount equaling
approximately $1,000.00.
B. The expense of nursing care exceeds $1,000.00 per month.
C. Since I have been appointed guardian for Mrs. Nardelli,
Mrs. Nardelli's expenses at the nursing home have been covered under

Medicaid. However, on April 22, 1980, I was advised by the Department
of Health and Rehabilitative Services that her Medicaid coverage
was being cancelled for the stated reason that her resources "exceed
the amount allowed under the provision of Title XVI now that we can
no longer exclude her home property as her principal place of
residence." A copy of .that notice is attached.
D. While I, as legal guardian, am appealing the action of HRS
in this matter, I consider it probable that the action will be
{ upheld, and as long as Mrs. Nardelli has this property, she will be (

barred from coverage. r
E. Unless the property is reduced to cash, there will be
insufficient funds to pay for the day to day care of the ward for
more than one month.
