WHEREAS, the design and capacity of the above-described
sewage and potable water treatment facility is sufficient to
accommodate not only the needs of OCEAN TOWERS but also the
needs of ISLAND VILLAGE, subject to the terms of this Agree-
ment.
NOk', THEREFORE, in consideration of the sum of Ten Dollars
{$10.00) and other good and valuable consideration in hand paid
by ISLAND VILLAGE to OCEAN TOWERS, receipt of which is hereby
acknowledged, and in further consideration of the following
covenants and conditions, each of which shall be deemed con-
sideration for the other, it is agreed by and between the parties
as follow*s
1. OCEAN T04r'ERS hereby grants to ISLAND VILLAGE the
right to utilize the sewage and water treatment facility
presently under construction by OCEAN TOWERS without charge
for connection thereto or payment of a reservation or capacity
fee. OCEAN TOWERS hereby agrees to reserve sufficient capacity
within the said sewer and water facility to accommodate the
needs of ISLAND VILLAGE, this obligation of OCEAN T047ERS being
I! not only in favor of ISLAND VILLAGE but also a covenant running
` to the lands of ISLAND VILLAGE described in Exhibit "C" hereof.

the installation and inspection of collection and distribution
lines for water and sewer service within the lands of ISLAND
VILLAGE more particularly described in Exhibit "C" attached
hereto and made a part hereof.
3. OCEAN TOWERS will use-due diligence in the completion
of the installation of the sewer and water treatment facility

in order that the same will be functional and operational to
serve the needs of ISLAND VILLAGE, it being understood by the
parties that ISLAND VILLAGE will need the water and sewer service
in advance of OCEAN TOWERS.
