O R D E R THIS CAUSE coming on to be heard on April 23, 1980 ' on Defendants' Motion to Dismiss Count I of the Complaint filed herein, and the Court having heard argument of counsel and con- sidered memoranda of law, finds and determines: The complaint does not allege sufficient ultimate facts to state a cause of action for negligent misrepresentation. The complaint must allege in paragraph 6 that the officer or agent of said Defendants. misrepresented to the Plaintiff that the entire premises were covered by the insurance policy and that in reliance of this representation, Plaintiff purchased the insurance policy. Therefore, said motion to dismiss Count I of the Complaint is hereby granted, with leave to amend within twenty (20) days from date.
