ORDER
This cause, having come on to be heard before me, on
May 1, 1980, upon Motion of the Counterdefendant MLP CONSTRUCTION,
ANC., to dismiss or strike and Motion of Counterplaintiff and
. Defendant GREENBRIER PLAZA, INC., to amend, and this Court having
consolidated all Motions for hearing on this cause, and being
otherwise fully advised in the premises, it is upon consideration
ORDERED AND ADJUDGED as follows:
1. Counts II and III of Counterplaintiff's Counter Complaint
against MLP CONSTRUCTION, INC., be and the same is hereby dismissed
with fifteen (15) days leave for Counterplaintiff GREENBRIER PLAZA,
INC., to amend.
2. The Motion to Amend of GREENBRIER PLAZA, INC., is
{
~ granted, and Counterdefendant MLP CONSTRUCTION, INC., shall have
twenty (20) days in which to answer said Counterclaim.

3. The Motion of MLP CONSTRUCTION, INC., to dismiss
or strike Count IV, being withdrawn before this Court, is
not ruled upon.
