THIS CAUSE coming on to be heard on t Pla i o p
and the Defendants' Counterclaim, the Cour't` having heard evidence from
the Plaintiff and receiving Exhibits introduced by the Plaintiff and the
Defendant having failed to appear, it is
ORDERED AND ADJUDGED as to Count I of the Complaint, the
contract by and between the Plaintiff, CHARLENE EDEN., and the Defendants,
ROBERT P. POWELEIT and CAROLE E. POWELEIT, is cancelled and hereby
declared null and void; it is further
ORDERED AND ADJUDGED as to Count I of the Complaint that the
One Thousand Dollars ($1,000.00) deposited by the Defendants as a down -
payment on the Plaintiff's property, is hereby declared to be forfeited
~ as liquidated damages; it is further
ORDERED AND ADJUDGED as to Count II of the Complaint, that
a Judgment be entered against the Defendants in the amount of Three
Thousand Four Hundred and Eighty Dollars ($3,480.00), which represents
unpaid rent, and a Judgment be entered against the Defendants in the
amount of Two Thousand Two Hundred and Twenty Dollars ($2,220.00), which
represents statutory held-over rent from August 16, 1979 through the
date of the eviction, December 4, 1979, pursuant to Florida Statute
§83.58, for a total judgment against the Defendants in a amount of
Five_ Thousand Seven Hundred a Dollars ( .00`~ it is further
