THIS CAUSE came on to be heard upon the Defendant's
Motion to Dismiss and Motion to Strike and the Plaintiff's Motion
for an Order permitting the filing of a Lis Pendens and the Court
having heard argument of counsel-and being otherwise advised in
the premises,
ORDERED AND ADJUDGED:
1. Defendant's Motion to Dismiss is denied.
2. Defendant's Motion to Strike is granted on the grounds
Plaintiff has failed to allege that there is an absence of a
usticiable~
awJ fact in the Defense of the cause. Plaintiff is

permitted to amend by interlineation to Counts 1 and 2 of the
Complaint.
3. Plaintiff's Motion for Lis Pendens is granted.
