TARPON BAY, INC., a Florida corporation, hereinafter referred to as "Mortgagor", by Mortgage Deed dated the 28th day of September, 1979, and recorded in Official Record Book 317, Page 2403, public records of St. Lucie County, Florida, mortgaged unto FIRST NATIONAL BANK IN PALM BEACH, a National Banking Corporation, its ! successors and assigns, hereinafter referred to as "Mortgagee", the premises therein particularly described, to secure the payment of the sum of Seven Hundred Eighty Thousand Dollars ($780,000.00) with interest as therein mentioned, as further secured by that certain Financing Statement recorded in Official Record Book 317, Page 2415, public records of St. Lucie County, Florida: AND WHEREAS, Mortgagor has requested tortgagee to release the premises hereinafter described, being part of the encumbered property, from the lien and operation of the Mortgage and the Financing Statement: NOW THEREFORE; Mortgagee, in consideration . of the sum of Sixteen Tho~nd Nine Hluydred Eighty Dollars 16,980.00 ) paid to it by Mortgagor, does remise, release, quitclaim, exonerate and discharge from the lien and operation of the Mortgage and the Financing Statement unto Mortgagor, all that piece, parcel or tract of land, being a part of the encumbered property, to-wit: UNIT 105 of TARPON BAY YACHT CLUB CONDOMINIUM H according to the DECLARATION OF CONDOMINIUM dated May 9, 1980 and recorded in Official Rec- _ ord Book 332 Page 133 , Public-Records of St. Lucie County, Florida; together with the undivided share of the COMMON ELEMENTS of the Condominium declared- in the Declaration to be appurtepant thereto; together with all appurtenances thereto, including, without limi- tation, the right of exclusive use. of those areas, spaces and portions of COMMON ELEMENTS of the Condominium, dec- lared in the Declaration of Condominium to be LIMITED COMMON ELEMENTS of the Unit.
