Motion to Dismiss and the court having heard argument of counsel and being fully advised in the premises it is therefor ORDERED AND ADJUDGED as follows: 1. Count II of Plaintiff's complaint be and the same ~ is hereby dismissed. 2. The court reserves ruling as to Count III of Plaintiff's complaint. The Plaintiff shall submit a memorandum of law in s g support of Count III within twenty days of the date hereof. Defendant shall have ten days from service of Plaintiff's memo of law to reply thereto. 3. Count IV of Plaintiff's complaint be and the same is hereby dismissed. 4.
