WITNESSETH• That Grantor, for and in consideration of the sum of TEN (110.00) DOLLARS and other good and valuable consideration paid by Grantee, the receipt of which is hereby acknowledged, has granted, bargained, and sold to Grantee and Grantee's heirs and assigns forever the following described real property situated, lying and being in St. Lucie County, Florida, to wit: The Condominium Parcel- known as Apartment 12 2 2A of Phase ~lof HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION II (the "Condominium") according Lo the Declara- tion of Condominium thereof, recorded ~ Official Records Book 304 at Pages 1396 through 1 08 of the Public Record-off St. Lucie County, Florida as such Declaration may have been adiended by any amendments thereto hereto filed in _ the Public Records of St. Lude County, Florida including, but not limited to, any amendment to add the aforesaid Phase to the Condominium (if such i Phase be other than Phase I thereof) . - i I Grantee, by acceptance hereof, and by agreement with Grantor hereby expressly assumes and agrees to be bound by and to comply with all of the covenants, terms, conditions and provisions set forth and contained in the aforedescribed Declaration of .Condominium, including, but not limited to, the obligation to make payment of assessments for the maintenance and operation of the Condominiwn which may be levied against the above described Apart- ment. Grantee expressly acknowledges the existence "of a Settlement Stipul~- tion and Agreement for and Grant of Easements and Other Rights (the "Settle- ment Stipulation") and a Declaration of Protective Covenants and Restrictions (the "Protective Covenants"), as hereinafter set forth. The Settlement Stipu- lation provides for this Condominium to be served by cer',ain fadlities of High Point -of Fort Pierce Condo®inium Section 1 and the Protective Covenants- provfdes .for certain land use covenants upon the land areas described .therein (including, but not limited to, portions of the land areas included within this i Condominium) and provides for certain drainage easements and other ease- ments and Mghts including, but not linadted to, the "Roadway Easement", - "Sewage System Rights" , "Water Systean Rights" . and "Future Development' Property Drair?nge Easement", all as are more particularly described therein, all in addition to- the other matters set forth in the Settlement Stipulation and Protective Covenants, which other matters include, but are not limited to, the obligation to pay certain "Assessments" as are respectively set forth in the Settlement Stipulation and Protective Covenants .
