HomeMy WebLinkAbout0392 or controlled by the land owners; and in such event, the perf orming parties shall have the full right and privilege of severing or obstructing any waterway and roadway serving such defaulting party at any place along the drainage and irrigation ditch, its beams and dikes, and the graded roadway, including any additional rights of way of, easements which may subsequently come into being, to facilitate the accomplishment of the overall objective sought by this ~reement . S. In the event of a sale of all or part of the lands described herein by either of the parties hereto, any right, title or interest in or to any of the rights of way of easements created in pursuance of this Agreement, including any additional rights of way which may subsequently come into being to facilitate the accomplishment of the overall objective sought hereby shall be conveyed expressly subject to the terms and conditions of this Agreement, and the future compliance by the succeeding owners with the obligations expressed herein shall be a part of the consideration for such instrument of conveyance as fully and completely as though this Agreement were therein set forth in its entirety. It is understood and agreed that a conveyance of any or all part of the lands not a part of the rights of way and easements by any party hereto, or his successors in title, carries to right, title or interest either at law or inequity in the water control ditch, the access graded roadway, or the two-way irrigation and drainage pump hereinabove described unless and until the proposed grantee accepts and agrees to fulfill the responsibilities imposed hereby.---No greater burden or lesser consideration will be imposed upon or accepted from any succeeding grantee or transferee of title with respect to becoming a party to this Agreement and the benefits obtainable thereby. 6. The supervision, operation and management of this cooperative. venture shall be vested equally in RELSETR and MOORE and their respective heirs, successors or assigns. No capital improvements other than those expressly described herein shall be authorized or undertaken without the prior written approval of the owner or owners holding a majority of acres from each of the said Parcels hereinabove described, 7.
