LUCIE COUNTY FLORIDA CASE NO. 80-176 CA MERKLE MOTORS, INC., a Florida corporation, Plaintiff, vs. TRAVELERS INDEMNITY COMPANY, a Foreign corporation, et al, Defendants. ORDER THIS CAUSE coming on to be heard upon the motion to dismiss and/or strike of the defendant, TRAVELERS INDEMNITY COMPANY, and the motion to dismiss and/or strike of the defendant, PHILIP FRANK MELUSO, and upon the argument of counsel, the Court being otherwise fully advised in the premises, it is ORDERED and ADJUDGED as follows: 1. The motions to dismiss are denied. 2. The motion to strike the statement as to damages and insert in its place a statement that the action is for damages exceeding $2,500.00 is granted. t 3. The Court specifically reserves its ruling on whether to I strike Paragraphs 36, 37, 38, 39 and 40 of the amended complaint as they relate to loss of reputation. The plaintiff's attorney is f ordered to provide the Court with a Memorandum of Law on this question within fifteen (15) days of the date of this order, and defense ~ counsel shall have fifteen (15) days from the serving of said memo in which to file reply memorandums on said question. 4. The .defendant, TRAVELERS INDEMNITY COMPANY, and PHILIP FRANK MELUSO, shall have ten (10) days from the date of this Order 3 in which to file responsive pleadings or otherwise plead. s 5.
