ORDER
THIS CAUSE having come to be heard upon the Motion
To Compel and for Sanctions of the Plaintiff and the Motion
to Dismiss of the Defendant and the Court having considered
same and having heard the arguments of counsel, it is
thereupon
ORDERED AND ADJUDGED as follows:
1. Plaintiff's Motion to Compel Defendant's appearance
for a Deposition is granted and the Defendant shall appear
for his deposition on the 2nd day of July 1980,
at 9:30 A.M. o'clock, at Florida Court Reporters, 201 S.
2nd Street, Ft. Pierce, FL 33450. Plaintiff's Motion for
Sanctions is denied, provided, however, if Defendant fails
j to appear at the aforesaid time and date for his Deposition
~ appropriate sanctions shall be imposed by this Court pursuant
' to the Florida Rules of Civil Procedure.
2. Defendant's Motion to Dismiss Counts II and VIII
of Plaintiff's Amended Complaint is denied and Defendant
shall have ten (10) days to file responsive pleadings thereto.

Amended Complaint is granted and Plaintiff shall have ten (10)

4. Defendant's Motion to Dismiss Count IX of Plaintiff's
Amended Complaint is denied and Defendant shall have ten (10)
