This mortgage also secure any and all renewab and extensions of the promissory note referred to herein and secured hereby, and all installments thereof, and also any other notes which have been or may be given to the Mort- gagee by the Mortgagor, and any other indebtedness of the Mortgagor to the Mortgagee which, however, shall not exceed at any one time the aggregate unpaid principal sum of .TM1.0 .HUNDRED. It all or any part of the property or an interest therein is sold or transferred by Mortgagor, excluding (a) the crretion of a lien or encumbrance subordinate to thin mortgage or (b) the creation of a purchase money security inter- est for household appliances, then, in that event, the then outstanding principal balance of the note secured by this mortgage. together with accrued interest, costa and future advances, if any, shall immediately be due end payable. Any such transfer or conveyance made without satisfaction o[ this mortgage shall rnnatitute a default under the note and mortgage securing name. 17. It Mortgagee deems itself insecure, or upon the happening of any of the following events, each of which shall constitute a default hereunder, all liabilities of each Mortgagor to Mortgagee shall thereupon or thereafter, at the option of Mortgagee, without notice or demand. become due and payable: la) the death o[ any Mortgagor (which term shall mean and include each Mortgagor, co-maker, endorser, surety and guarantor of this mortgage); Ib) the filing of any petition. under the Brankruptcy Act, or any similar [ederal or state statute, by or against any Mortgagor: (c) an appli- cation for the appointment of a receiver tor, the making of a general assignment for the benefit of creditors by, or the insolvency of any Mortgagor; (d) the entry of a judgment against any Mortgagor: le) the issuing of any attachment or garnishment against any property of any Mortgagor: (f) the taking of possession of any substantial part of the property of any Mortgagor at the instance of any governmental authority; Ig) the dissolution, incompetency, merger, consolida- tion. or reorganization of any Mortgagor. 18. This Mortgage Deed and the note it secures shall be construed only under the laws of the State of Florida. PROVIDED ALWAYS, and this mortgage is on the express condition, that if the Mortgagor shall well and tnrly pay unto the Mortgagee the said sum of money mentioned in said promissory note referred to herein and secured hereby and any renewals or extensions thereof, any further advances and any other indebtedness referred to herein, in what- ever form, and the interest thereon as it shall become due, according to the true intent and meaning thereof, together with all costs, charges and expenses, including a reasonable attorney's fee, which the Mortgagee may incur or be put to - in collecting the same by foreclosure or otherwise, or in protecting the security o[ the Mortgagee, whet,~er by aui~~T otherwise and shall well and truly keep, observe, perform, comply with and abide by each and evet~.;tlieE 'Iiet~,`' agreements, conditions and covenants of said promissory -note and this mortgage as and when requi - _ -c>ii~,~'~_ mortgage and the estate hereby created anal! cease and be null and void, otherwise the same sha)r~:'- ~ ~ _ force and effect. -1t4 k* .
